01 Who we are

Brothers Excavation and Concreting Pty Ltd (ABN 98 701 417 254, ACN 701 417 254) operates from the Plumpton and Rockbank area of Victoria (VIC), postcode 3335, and provides excavation and concreting services. In this policy, "we", "us" and "our" mean that company.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) set out in that Act. This policy explains how we handle personal information, as required by APP 1.

02 What we collect

We only collect personal information that is reasonably necessary for our work as a building and construction contractor. That normally means:

• Contact details — your name, email address, and any phone number or postal address you choose to give us.
• Site and project information — the address of the property, lot and estate details, engineering and siting plans, soil reports, council requirements and the scope of work you want priced.
• Correspondence — the content of emails and enquiry forms you send us, including quotes, variations and site notes.
• Billing information — the details needed to invoice you and record payment. We do not collect or store credit card numbers through this website.

We do not seek sensitive information as defined by the Privacy Act 1988 (Cth), and ask that you do not send it to us. If you deal with us anonymously or under a pseudonym we will accommodate that where it is lawful and practicable, though we generally cannot quote or carry out construction work without knowing who the client is and where the site is.

03 How we collect it

We collect personal information directly from you — when you email us, complete the enquiry form on this website, speak with us about a site, or engage us to carry out work.

Sometimes we collect information about you from a third party, such as a builder, project manager, architect, engineer or council, where that is necessary to price or perform the work. Where we do, and where it is reasonable to do so, we will take steps to make you aware of it as required by APP 5.

04 Why we collect it and how we use it

We use personal information for the purpose it was collected for, and for directly related purposes you would reasonably expect. In practice that means:

• Preparing quotes and scopes of work, and answering your enquiry.
• Planning, scheduling and carrying out excavation and concreting works.
• Coordinating with builders, engineers, suppliers, concrete plants and council where the job requires it.
• Invoicing, collecting payment and keeping our financial records.
• Meeting our obligations under work health and safety, building, tax and other Australian laws.
• Handling questions, defects and disputes about work we have done.

We do not use your personal information for direct marketing without your consent, and we do not sell, rent or trade personal information to anyone.

05 Who we disclose it to

We may disclose personal information to:

• Subcontractors, plant hire operators and suppliers engaged on your job, limited to what they need to do their part of the work.
• Builders, engineers, building surveyors, private certifiers and local councils where they are involved in the same project.
• Our accountants, bookkeepers, insurers and legal advisers.
• Our email and IT service providers, who store data on our behalf.
• A court, tribunal or government agency where we are required or authorised by Australian law to disclose it.

We do not currently disclose personal information to overseas recipients for the purpose of carrying out work. Some of the email and hosting providers we use may store data on servers located outside Australia. Where that occurs we take reasonable steps, as required by APP 8, to ensure the recipient handles the information consistently with the Australian Privacy Principles.

06 This website and cookies

This website is a set of static pages. It does not use tracking cookies, analytics scripts, advertising pixels or third-party embeds, and it does not build a profile of visitors.

The enquiry form on our contact page does not submit data to a server. It opens a message in your own email program, which you then send yourself. Until you press send in your email program, we receive nothing.

Our hosting provider may keep standard server logs, which can include IP addresses, for security and reliability purposes. We do not use those logs to identify individual visitors.

07 Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, as required by APP 11. Those steps include restricting access to our email and records to the people who need it, and using reputable service providers.

We keep personal information for as long as it is needed for the purpose it was collected, and for as long as we are required to keep it by law. Construction, tax and warranty records are commonly retained well after a job is finished for that reason. When information is no longer needed and we are no longer required to keep it, we destroy it or de-identify it.

No method of transmission or storage is completely secure. Please take care when sending documents to us by email.

08 Accessing and correcting your information

Under APP 12 and APP 13 you may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.

Email your request to [email protected]. We will ask you to verify your identity and will respond within a reasonable period. Access is free, although we may charge for the reasonable cost of supplying copies of a large volume of documents. If we refuse access or refuse to make a correction, we will tell you why in writing and explain how to complain.

09 Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, email [email protected] with the details. We will acknowledge your complaint, investigate it and give you a written response within a reasonable period.

If you are not satisfied with our response, you may take your complaint to the Office of the Australian Information Commissioner (OAIC), which oversees the Privacy Act 1988 (Cth). The OAIC can be contacted at oaic.gov.au or by phone on 1300 363 992.

10 Notifiable data breaches

If we become aware of a data breach involving personal information that is likely to result in serious harm, we will assess it and, where the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth) applies, notify the affected individuals and the OAIC as required.

11 Changes to this policy

We may update this policy from time to time to reflect changes in how we operate or in the law. The current version is always the one published on this page, and the date at the top shows when it was last changed.
